It was a client’s last-minute decision to retain my services with only hours to review her entire case. A difficult immigration case with an interesting twist. The client was on the verge of losing her temper with the immigration officer and almost self-incriminating herself during the removal of conditions waiver interview. It was my decision to stop the interview and not allow the client to speak any further. A closing argument was made on why the client deserves the 10-year green card. Months later, my client received the permanent green card!

Immigration Judge in Hartford, CT allows the client to keep his green card after a lengthy individual hearing surrounding his prior arrests
Preparation is key when getting your clients ready for an individual hearing before the immigration judge in any state. My client had prior arrests and one specific arrest involving endangering the welfare of a child in the state of NY. Client was eligible to file a 212c waiver before immigration court, which is a discretionary waiver. The client was well prepared for the hearing and testified confidently when he was cross examined by the trial attorney. The Judge looked closely at the balance of positive factors versus negative factors in the client’s application and evidence submission. The immigration judge granted the 212c waiver and client was able to keep his green card.

80-year-old woman obtained entry into the US with Special Agricultural Worker (SAW), later enters removal proceedings where the immigration judge allows her to keep the green card. USCIS gave her a hard time to become a US citizen when she filed for naturalization – until now!
One of the things I like to do is look at each applicant’s entire immigration history. Procedurally and factually, a person’s immigration background can tell you a lot. A woman had documents filed with US immigration since 1986 along with allegations against her for fraud and misrepresentation, which ultimately led her into removal proceedings. The immigration judge granted her relief and she was able to keep her green card. She decided to file for naturalization which kept getting denied. She applied again and this time she was going in for a re-examination for citizenship and decided to retain an immigration attorney. I received her 3,500-page immigration file with only a day in between her interview. I went through everything (page by page) to discover that she was more than eligible to receive her citizenship.
On the day of the interview, this was probably the most speaking I have ever done for a naturalization process. Client aced her civics questions but it was the procedural history that kept creating issues for her. It was one piece of paper and the arguments I made at the interview that led to the client being approved for citizenship!
